Complaint cites police leaders

DEPTFORD TWP. A police sergeant has filed criminal complaints against two superior officers, including the chief of police here, accusing them of witness tampering, obstruction and lying on the witness stand.

The allegations, filed on Friday in municipal court in Deptford and Woodbury, allege that Police Chief John Marolt and Capt. Daniel Murphy threatened to retaliate against Sgt. John Leone if he testified on behalf of a fellow officer. They are also accused of lying to a judge when questioned about the alleged acts.

The attorney for Marolt said it was important to note these allegations made by Leone have not been investigated by a grand jury or other police agency, calling them "unfounded and baseless."

"I think what's at stake here is the reputation of an individual who has five years as police chief and a 28-year reputation in law enforcement," defense attorney Frank J. Hoerst of Woodstown said Friday evening. "It is a tragedy to sully that reputation with this allegation that we feel we will meet head on and vigorously defend."

Murphy said he could not comment because the case is under investigation.

Leone, a 10-year veteran of the force, referred all questions to his attorney William Buckman, who did not return calls for comment.

The charges stem from the trial of Ptl. John Gillespie, who was accused along with another officer of beating up a handcuffed man during a traffic stop on Feb. 2, 2006.

Gillespie, charged with official misconduct and assault, was acquitted at trial in July.

Charges against the other two officers at the root of the investigation were ultimately dropped by prosecutors.

The Times has learned Gillespie and Ptl. Timothy Parks the other officer charged with assault and misconduct will be returning to work on Monday.
