Ex-cop pleads out

The actions of a city cop who conducted unauthorized computer checks involving a Hells Angels associate were "foolish, but not evil," his lawyer told court yesterday.

Bruce Huynen, 40, pleaded guilty to one count of unauthorized use of a computer.

The 16-year veteran of the force was arrested Sept. 15, 2004, at the same time police were conducting a series of raids across North America targeting an international ephedrine smuggling ring allegedly based in Manitoba.

It was during that investigation, dubbed Operation Diversion, that information was discovered, sparking a separate investigation of Huynen involving one of the suspects accused in the smuggling ring.

The Crown alleges the suspect asked a friend of Huynen's, a Calgary business owner, to use his "police contacts" to help him find his ex-girlfriend and another man who had stolen $460,000.

Police wiretaps recorded several phone calls between Huynen and the Calgary man, who asked Huynen to access various police databases to help locate the missing woman and man. Huynen did so 11 times over the course of several months, beginning in late 2003.

'NEVER INTERFERED'

"This is not a case of a police officer running the name of an attractive woman for a friend," said lawyer Marty Minuk, acting for the Crown. "It is evident from these calls that...the purpose of these inquiries would, to any listener, raise a concern that harm might come to the individuals who took this money."

Huynen's lawyer, Hymie Weinstein, said Huynen thought he was helping his friend who was worried about criminal rumours involving his business partner.

"There was absolutely nothing in this for Mr. Huynen," said Weinstein. "He never interfered with any investigation on the part of the RCMP or city police."

Weinstein urged Judge Ray Wyant to grant Huynen an absolute discharge, arguing he had already suffered the loss of his career and reputation.

"The consequences that have already befallen Mr. Huynen far outweigh anything the court can order here," he said. "Because of a friendship, he has suffered greatly."

Judge Ray Wyant reserved sentencing.

Huynen resigned from the police force in April of last year.

When arrested, Huynen was charged with 14 additional counts of criminal breach of trust, attempting to obstruct justice and unauthorized use of a computer. Those charges will be stayed in court today.
