A NEW sex harassment scandal has rocked NSW Police, with at least one officer in its forensic services group to be disciplined.

The Daily Telegraph has learned of an internal investigation into claims of misconduct dating back five years.

A female member of the group, the equivalent of the CSI, is believed to be on extended sick leave while all staff have undergone mandatory sex and gender-based education. A spokeswoman confirmed an officer would be disciplined, saying: "NSW Police is considering disciplinary action for officers as a result of the complaint."

Officer's hearing open to publ

An Evansville Police Department officer recommended for firing by Chief Brad Hill will appear in front of the Police Merit Commission next month for a disciplinary hearing.

The commission on Monday afternoon set a 2 p.m. Aug. 3 hearing date for Martin Montgomery, a three-year veteran who was accused in a personnel order of neglect of duty, improper conduct and other violations.

In addition to the internal investigation into Montgomery's conduct, a criminal probe also was launched. A grand jury will consider possible charges against him Monday.

Citing the ongoing investigations, officials have declined to release the specifics of Montgomery's alleged misconduct.

But the merit commissioners voted unanimously to make the hearing open to the public, meaning the full allegations could come out then.

All three merit commissioners said even they do not know the specifics of the allegations against Montgomery beyond the general outline of the violated policies described in Hill's personnel order.

The Rev. Adrian Brooks, president of the commissioners, said this process is following the same guidelines as all disciplinary hearings.

"We want to be fair to everybody involved, so the process is consistent and above board," he said.

Commissioner Mike Lauderdale, a retired officer, acknowledged it always is hard to see an officer accused of an offense severe enough that the chief wants him fired.

"I hate to see that, obviously," Lauderdale said.

If Montgomery is indicted later this month, an affidavit of probable cause detailing the alleged offense would become public.

An indictment also would delay the disciplinary hearing, Hill said.

Montgomery's alleged misconduct is said to have taken place June 16. He was placed on administrative leave with pay that same day and, on June 19, suspended for 21 days without pay and recommended for firing. That is the maximum penalty the chief can levy before an officer goes in front of the merit commission.

Montgomery will remain suspended until the commission hears the case and votes on it.
