LOVING Former Loving Police Chief Harvey Rodriguez says he is the victim of a conspiracy and his rights were violated when the Loving Village Council fired him two years ago.

Cop Cleared of Corruption, Uni
A local police officer fired for allegedly fixing tickets has been rehired at the San Luis Police Department. Sgt. Earnie Lugo has been cleared of the allegations against him. The City of San Luis fired Lugo in December 2008, accusing him of wrongfully dismissing seven tickets.
A law enforcement union called AZCOPS represented Lugo in his appeal, and the union blames acting police chief Capt. Javier Nuno.
The hearing found two of those tickets, which were criminal citations, had in fact not been dismissed. Reports show Capt. Nuno still recommended Lugo lose his job.
"So he knew that they hadn't been, he knew they'd been a guilty plea, and he did it anyway," says Martin Bihn, general counsel for AZCOPS.
A report by AZCOPS questions the Captain's integrity, offering two reasons why Nuno is unfit to lead. It states: "Our point is that either Captain Nuno deliberately lied about the tickets to get Lugo fired or he just failed to grasp that if a ticket is paid, it means the ticket was not dismissed. Either scenario should give the City significant concern with the Captain and his abilities."
As for the five other tickets in question, the hearing determined Lugo was justified when he cancelled them because the responding officer was unable to calibrate his radar gun.
"There are policies that aren't followed at all," says Bihn. "Some policies are followed incorrectly, and in other cases, they don't have a policy for very important issues."
AZCOPS requested the San Luis Police Department conduct an audit, but the union says the ageny has not taken action.
According to San Luis Police Sgt. Gerardo Torres, Lugo was rehired about two months ago as a transfer officer with the municipal court.
As of Monday evening, KSWT has not received any comment about the controversy surrounding Lugo's previous dismissal. Our calls to the San Luis Mayor, acting City Administrator, and acting Police Chief have gone unreturned so far.
