Ex-police chief is fined $1,00

Former Waltham Police Chief Edward Drew has been fined for violating the state's conflict of interest law in connection with a departmental job posting involving his daughter.

Drew, who retired July 7, 2007, after seven years as chief, was fined $1,000 by the State Ethics Commission because of his involvement in a selection process in which his daughter, Officer Jennifer Vadnais, was an applicant.

According to a statement released by the Ethics Commission, in fall 2005 Deputy Police Chief Paul Juliano was in charge of selecting three background investigators - a temporary assignment for full-time officers.

On Nov. 23, 2005, Drew expressed his concern about the selections, which did not include Vadnais, according to the Ethics Commission.

He apparently asked Juliano why those who were not selected, including his daughter, were told they didn't have enough seniority while those with the same amount were picked.

Drew, who was with the department for 33 years, also asked Juliano why an officer who was sought out to apply for a position received assurance that he would be selected, even though the officer had not submitted an application, the commission said.

Drew also pointed out to the deputy chief that some officers who were solicited to apply had not submitted significant reports or been involved in noteworthy investigations, according to the commission's release.

"While members of the same family can work in the same department without violating the conflict of interest law, public employees must steer clear of matters involving their immediate family members, even if they feel that the family member has been treated unfairly," Commission Executive Director Karen L. Nober said in the statement.

Drew did not ask Juliano to take any specific action, according to the Ethics Commission's disposition agreement. According to the statement, Juliano told Drew at the end of their conversation that he planned to eliminate one of the positions and therefore rescind one of the appointments.

Drew left the department amid a backdrop of a report commissioned by Mayor Jeannette McCarthy in 2006 after receiving several complaints, some from officers and some from anonymous sources, concerning allegations of favoritism, nepotism and wrongdoing in the department.

The mayor could not be reached for comment.

The commission can impose fines of up to $2,000 for a violation of the conflict of interest law.
