The Buffalo Police Department is investigating one of its own.

The Department tells 2 On Your Side a 19-year-old University at Buffalo student says 37-year-old Officer Monte Montalvo forcibly performed a sex act on her. The officer was not on duty when the alleged incident occurred. Officer Montalvo is suspended with pay.

Commissioner McCarthy Gipson issued the following statement about the alleged incident: "We are looking into allegations regarding Officer Montalvo's off-duty conduct and how they relate to the rules of this department. The Professional Standards Division of the Buffalo Police Department began its investigation immediately after learning of the incident. The criminal aspect of this case is in the hands of the District Attorney's office."
