Police officer is fired for pr

A Jamestown police officer suspended for making a crude comment to a female officer of the department has been fired following a series of civil service hearings on professional misconduct.

Tim Smeraldo, an 18-year veteran of the department, was terminated Wednesday, Police Chief Rex Rater confirmed. Rater said the firing mirrors the Monday recommendation of Thomas Rinaldo, the hearing officer, who sustained the five counts lodged against the officer.

Rater declined to be specific, only to say the action was merited because of a “progressive discipline.”

James Subjack, Smeraldo’s attorney, said Friday that he’s “disappointed” by the hearing officer’s ruling and the city’s action. A Fredonia attorney and former Chautauqua County district attorney, Subjack said the ruling is “disproportionate” punishment to the nature of the charge and an appeal is being considered.
