Database leak worries WA polic

Liberia: Police Director Not A

For the second week, the Magistrate of the Monrovia City Court has been confronted with hurdles to have the Director of Police disrobed and turned over for prosecution. There appears to be an absolute lack of cooperation between the Ministry of Justice, which has the enforcement power and the Magisterial Court.

Last week, Magistrate Milton Taylor communicated with the Minister of Justice, Cllr. Frances Johnson-Morris to disrobe Director Munah Sieh to enhance her prosecution before the court. The Magistrate wants the Police Inspector General to answer certain questions involving some vehicles that were ordered arrested based on instruction from her.

The Police Chief has failed to show up since a writ of summon was issued to the effect. A standoff ensued between Magistrate Taylor and the Police Inspector General following the official turning over of the seized items, including the vehicle to the court. According to reports, the Sheriff of the Court was seen driving the vehicle near the Ministry of Foreign Affairs when the police arrested it on ground that it was bearing a foreign license plate. But the Justice Minister said if what the police Inspector General told her concerning the vehicle were true, then the police was right to arrest the vehicle and that the action was not done to disregard the Court.

So far, the Magistrate's request to have the Inspector General disrobed remains quenched with the Minister of Justice applying legal technicalities to evade a matter that falls within the confines of the Ministry as stated by the constitution. However, Cllr. Morris insisted that she does not have any legal authority under the law to disrobe a presidential appointee in which category the Inspector General falls. Notwithstanding, the law does not grant immunity to the Inspector General, especially if she impinges on the credibility and integrity of the court. Director Sieh cannot be the one to conspicuously challenge the jurisdiction of the judiciary or its functionaries. For the past three weeks, she has been in confrontation with the court, which is not a good reflection of a senior law enforcement officer.

Under our law, the Executive Branch is the enforcement arm of government. It is mandated by law to enforce rulings or orders coming from the courts. Therefore, the statement by the Justice Minister is not only intended to shield the Inspector General, but also to embarrass the court, which relies on the Ministry to enforce the law. The failure by the Justice Minister to enforce an order coming from the court undermines the authority of the court and exposes it to public ridicule. Let it be clear that the Police Director is not above the law therefore, she must be subjected to prosecution when necessary.
