Police defend shooting axe-wie

VICTORIA Police say their officers had no other choice when they shot and killed a 34-year-old man armed with an axe in a street in Melbourne's west.

The man, named in newspaper reports today as Michael Bugeja, had been wielding the axe moments before the fatal shooting about 9.20am (AEDT) yesterday.

He was shot by police several times in the upper body and died near his house in Frank Street, Sunshine West.

Victoria Police assistant commissioner Sandra Nicholson said the the officers involved had no alternative but to shoot the man.

"They had no other course of action available to them at the time," Ms Nicholson told the Nine Network today.

"If there were other things available to them at the time ... police dogs, perhaps that may have made a difference, but the incident happened quite quickly."

Ms Nicholson said the officers were initially called to respond to a neighbourhood dispute when they encountered the man.

"When they arrived there the male was already in an aggressive manner, they attempted to calm him down; however, he became more aggressive."

She said officers also could not use capsicum spray to subdue the man.

"They did take it out of the scabbard but unfortunately they weren't in a position to use it," Ms Nicholson said.

"Capsicum has a limited distance over which you can use it and they didn't get to that distance at an appropriate time to be able to use it."

Bugeja was single and lived in the house with his parents.

The officers involved are believed to be in their mid-20s and from the Sunshine police station.

Homicide squad detectives are investigating the fatal shooting, with the investigation overseen by the police Ethical Standards Division.

Bugeja was reportedly on bail facing charges including intentionally causing serious injury.

The Herald Sun reports today Bugeja was on bail and was due to appear in the Melbourne Magistrates' Court on March 5 on charges of armed robbery, intentionally causing serious injury, damaging property and common law assault.

The charges were laid by detectives from the Embona anti-armed robbery task force, the newspaper said.
