Informer battles for police pr

A KEY informer in the case against slain Melbourne gangland boss Mario Condello is battling in Victoria's Supreme Court to reverse a decision by police to force him and his partner out of the state's witness protection program.
The witness, who can be identified only as 166, took the action after Victoria's Office of Police Integrity rejected his last-ditch appeal on January 22 to remain in the program.
The witness has applied to have the Supreme Court intervene on the basis that the process used by the OPI and the Victoria Police was flawed. The OPI and Victoria Police are opposing the bid.

During a brief hearing yesterday, judge Bill Gillard said he was reluctant to have the matter heard in a closed court, the normal practice for witness protection matters, and kept the court open. The hearing is expected to resume tomorrow.

Earlier, a court ordered that armed police protection for 166 and his partner be restored pending the outcome of the case.

The legal battle is believed to be the first time in Victoria that someone on witness protection has fought against involuntary termination and it is being viewed as an important test case.

The Australian revealed last month that Victoria Police had terminated 166 and his partner from witness protection on the grounds that the threat to his safety had diminished and that his behaviour was allegedly unacceptable. The witness and his partner were to be provided with new identities and help in finding accommodation, but would not receive financial benefits.

The witness was allegedly offered $300,000 by Condello to kill two underworld rivals at the height of Melbourne's bloody gangland war, during which at least 28 people were murdered.

But at the time 166 was working as an informer for the Australian Crime Commission and the Victoria Police's Purana gangland taskforce and he secretly recorded his meetings with Condello in May 2004.

He testified at Condello's committal hearing on conspiracy to murder charges, but the underworld boss was killed in February last year outside his Melbourne home on the eve of his trial. Condello's killer or killers have not been caught and 166 has told police he believes he will be killed in revenge for informing on Condello.
