Man gets four months after try

A Bangladeshi man was sentenced to four months' imprisonment by the Bandar Magistrate's Court after he pleaded guilty to an offence under Section 6(b) of the Prevention of Corruption Act (Chapter 131).
A press release from the Anti-Corruption Bureau stated that, based on the investigation conducted by the Bureau, it was found that on June 6, 2006 along Jalan 10 Selatan in Kampong Perpindahan Lambak Kanan, the defendant, Abdul Kalam bin Md Shabed Ali, 52, corruptly offered a gratification of B$20.00 to two Police Constables named PC 3549 Razulan bin Hj Samad and PC 4926 Ak Hj Md Aminol Amilin bin Pg Hj Ramli who were attached to the Lambak Kanan Neighbourhood Police Post. The gratification was an inducement for not taking action against him for violating Road Traffic Regulations.

Investigations revealed that the defendant was driving a car which had discharged thick fumes from its exhaust pipe when he was stopped by the two police constables who at that time were patrolling the Kg Perpindahan Lambak Kanan area.

When one of the Police Constables told the defendant that he was going to issue a warning letter to him, the defendant put a B$10.00 note inside the trouser pocket of one of the constables. However the constable threw the money to the ground. The defendant then picked up the money and added another B$10.00 and put it again inside the constable's trouser pocket.

The other constable then warned the defendant that the defendant had committed corruption, and reported the matter to the Berakas Police Station.

Before passing the sentencing, the Senior Magistrate stated that the act of bribery is a serious offence regardless of the amount involved. The defendant had violated Road Traffic Regulations on which a small amount of fine can be imposed, but the defendant chose to bribe the Police, the press release added.

What was worse was that after the Police rejected the money, the defendant attempted to bribe the Police with more money. It seemed that the defendant had no respect for the law enforcement officers and that the defendant had made the presumption that they could be bribed. The Senior Magistrate added that the deterrent sentence to the defendant is appropriate as it shows and would at the same time remind the public that the court is intolerant to any corruption activities.

The senior magistrate also commended the two Police Constables for their actions of not receiving or accepting the bribe, showing a good example of vigilance when performing their duties.

The Senior Magistrate sentenced the defendant to four months' imprisonment effective from yesterday, and the money involved was forfeited to the State.
