St. Helena Police Jury head pa

DENHAM SPRINGS — The St. Helena Parish Police Jury president has paid a $1,000 fine to the state Board of Ethics for voting in June 2004 to have the parish pay for lumber purchases from his brother’s company, the police juror said Thursday.

Charles Davis said he paid the fine about two months ago as part of a joint agreement with the board. The agreement, called a consent opinion, was made public earlier this week. The board approved it a week ago Thursday, a board attorney said.

The opinion says the board found Davis and the company broke the state ethics code. The board gave Davis a $2,000 civil fine and suspended half. The board gave his brother’s company, Paul Davis Lumber Co., a $5,000 civil fine, suspending half.

The Police Jury bought $16,505 worth of lumber from Paul Davis Lumber Co. between May 2002 and May 2005 while Davis was a police juror. The Police Jury approved a $15,000 payment June 8, 2004, and Davis voted for it, the opinion says. He said he knew only that the Police Jury had bought from the company while he was not a police juror between 1996 and 2000.

In June 2004, Davis said, he unknowingly signed off on and voted for requisitions the Police Jury superintendent submitted. The Police Jury generally approves payments in bulk.

“That’s my fault for not looking at each requisition and that’s why I went ahead and paid the fine,” Davis said. “Sometimes, you’re guilty when you’re really not.”

The state code prohibits elected officials from participating in governmental transactions in which immediate family members or their companies have a substantial economic interest. Davis could have avoided the fine by abstaining from the vote.

At the time of the purchase, Davis’ brother, Paul Davis, held a nearly 65 percent stake in the company. Paul Davis also was in a coma at the time and his children were running the company, Charles Davis said.

The state code does not consider nieces and nephews “immediate family.”

Paul Davis has since died, Charles Davis said.

The board also found the company violated a prohibition on people or their companies doing business with governments where immediate family members serve.
