Brownstown Twp. deputy sues 4

Brownstown Township's deputy police chief has filed a whistle-blower lawsuit against the township and four of its trustees. James Sclater claims trustees defamed him and did everything possible not to promote him to chief.

According to his complaint filed Thursday in Wayne County Circuit Court, Sclater was discriminated against because of his involvement in internal investigations and because he informed the FBI and other township officials about alleged offenses committed by township employees. The alleged offenses include allegations of police misconduct.

The township and two defendants, Trustee Suzanne Harris and Trustee Albert Mann, declined to comment. Treasurer and Trustee Diane Philpot and Trustee Edwin Neal also are named in the suit. Sclater is suing for more than $25,000.

Last March, township Police Chief Bob Grant announced he was retiring, and Sclater was made acting chief. The four defendants -- a majority of the Board of Trustees -- voted to conduct an external candidate search, using an Ann Arbor headhunting firm. Neal, a former township police officer whom Sclater had disciplined, acted as the liaison.

Presented with three finalists, including Sclater, the four voted in September to hire Dennis Richardson, a former Detroit police official who has a professional connection to Philpot.

According to the lawsuit, Philpot made defamatory comments about Sclater, including comments about officers quitting when Sclater was acting chief because of low morale and his vendettas against them. The lawsuit said Philpot also commented that during that time overtime soared and said Sclater lied to the public and the board about the department.

When Richardson declined the job, the four voted in October to hire another candidate, who also said no. In November, the four trustees voted against promoting Sclater.

Later in November, Richardson accepted the chief's job.

"He's 25-year veteran with a perfect record," David Selwocki, Sclater's attorney, said Thursday of Sclater. "He was the second in command, like a vice president, a heartbeat away from chief."
