Probe on court brawl

ALLEGATIONS that at least one Office of Police Integrity staff member assaulted a detective at the centre of an OPI investigation are being investigated.

The claims relate to chaotic scenes at the County Court last September during an OPI hearing into assault claims levelled at armed offenders squad detectives.

One of the detectives at the centre of the OPI investigation, former Sen-Det Robert Dabb, was grabbed from behind, restrained and allegedly manhandled during his day of evidence when he tried to walk from the courtroom to use a public toilet.

Mr Dabb, whose resignation from Victoria Police became effective on Friday afternoon, has alleged it was OPI staff who attacked him.

Several of Mr Dabb's colleagues not under investigation but sitting in the courtroom stood and protested, with one yelling: "Is he under arrest?"

Some leapt to Mr Dabb's defence as he shouted: "Get your hands off me."

Mr Dabb was a witness and had not been charged with a criminal offence at that stage.

He believes that his treatment constitutes unlawful imprisonment and assault.

Victoria Police has confirmed Mr Dabb's complaint is being investigated by the internal affairs unit, otherwise known as the ethical standards department.

Ironically, the OPI and ESD have worked hand in hand on several previous investigations. Now, ESD detectives are effectively investigating their allies.

A statement issued to the Herald Sun said: "Victoria Police can confirm that ESD are investigating allegations of assault and unlawful imprisonment against OPI staff.

"As the matter is currently being investigated it would be inappropriate to comment further."

It is believed Mr Dabb did not report the incident to his local police station until this month because of a stress condition.

His allegations were passed to the crime department, and then to an independent magistrate, before ending with ESD.

After the incident at the County Court, Mr Dabb collapsed in the witness box.

He and former colleagues Mark Butterfield and Matthew Franc have since been charged with assault offences.

They were charged on Friday with further offences relating to answers given at OPI hearings.

All three will face the Melbourne Magistrates' Court next month.

All three deny assaulting an armed robbery suspect.

Also charged over the alleged interview-room assault is Det-Insp Bernie Rankin, a former head of the homicide squad.

After originally being charged with counselling or procuring an assault, his charges have been increased to include a multitude of assault offences.

The police union branded last year's OPI public hearing a "Spanish inquisition" because the detectives called were denied the right to silence.

The criminal who made the allegations against the charged detectives has more than 65 criminal convictions including armed robbery, recklessly causing injury, resisting police and possessing a pistol.
