The New South Wales Police Commissioner has hinted charges may not eventuate against two Wagga police officers, from the state's south, who were under investigation by the Police Integrity Commission (PIC).

No action over man shot by pol

Two police officers involved in the fatal shooting of a man who had a gun-shaped cigarette lighter will not face any disciplinary action.
Derek Bennett was shot by police marksmen in Brixton, south London, in June 2001 after holding the lighter to the neck of a member of the public.

The Independent Police Complaints Commission (IPCC) said there was no evidence of misconduct.

The Court of Appeal last week ruled Mr Bennett was shot lawfully by police.

Since the shooting, Mr Bennett's family have campaigned for disciplinary action to be taken against the police.

Psychiatric patient

But IPCC Commissioner Mehmuda Mian Pritchard said: "After considering the investigating officer's report, the inquest and subsequent legal proceedings, I have concluded there is no evidence of misconduct by the two firearms officers involved.

"I am acutely aware of the enormous impact this case has had on everybody concerned."

Doctors had recommended that Mr Bennett, a former psychiatric patient, be committed to a mental hospital under the Mental Health Act just a week earlier.
