Investigation of Plainfield ch


PLAINFIELD -- The investigation into alleged misconduct by the police chief will remain an internal review, the first selectman said Friday.

First Selectman Kevin Cunningham said there is no criminal investigation, so the issue involving Chief Gary Sousa will remain within the authority of the police commission.

The integrity of the police commission's ongoing investigation into allegations of misconduct by Sousa was thrown into question Thursday after Police Commission Chairman Jackie DuBois said phone records show Sousa has been talking daily to people involved in the investigation. She said he has spoken with a witness and four members of the police commission after being instructed in April to have no contact with them.

Dubois has asked those commission members to resign. She said Friday she is looking into filing a formal complaint on the issue with the town ethics board.

He added two issues town officials have with Sousa are his failure to comply with the order to discontinue contact with parties involved in the investigation and failure to comply with the investigation by not meeting with a town-hired private investigator.

"His communication with commission members seems to dictate they no longer have control of this," Cunningham said.

Dubois said Sousa violated the police department's rules and regulations by conducting what she claims was personal business on company time. The records showed many of the phone calls were made from April through August, with some conversations lasting nearly two hours.

Dubois said if the calls to members and witnesses were not personal, the calls could constitute an illegal chain meeting.

"In my opinion, this has been a gross miscarriage of justice for the people of the town of Plainfield," Dubois said in a prepared statement Thursday.

Dubois, Cunningham and some residents say the commission cannot complete a fair investigation, and the issue now will take longer to resolve.

Two of the four members involved in the phone calls to Sousa's phone number, Alice Cote-Tetreault and Hollis Hooper, were present at Thursday's meeting. They did not resign from the board. The other board members could not be reached Friday for comment.

Resident Donna Finnemore said she no longer trusts Sousa or the four commission members accused of talking to Sousa during the investigation.

"I think that it speaks volumes that this commission is tainted and cannot make a determination that is not biased," Finnemore said.

Sousa, 58, has not faced disciplinary action and maintains his regular job status during the investigation. Sousa Friday declined to comment on the matter.
