Chief hears charge of corrupti

BELCHERTOWN - Police Chief Francis R. Fox Jr.'s method of administering a self-defense course for instructors "looks an awful lot like public corruption," according to the lawyer for the town.

"At the end of the day town money was used for a private program," said town lawyer Marc L. Terry, who accused Fox of not being truthful and making contradictory statements.

"The bottom line is the chief was wearing two hats. He was running a private program and being a chief," Terry said.

The second part of a hearing on Fox's future with the Belchertown Police Department was held yesterday at Town Hall. Fox's wife and daughter, along with about 20 other people attended the hearing.

Fox, a member of the Police Department since 1987, has been on paid administrative leave since May 30. His lawyer Andrew J. Gambaccini pleaded with hearing officer Anthony T. Rice to allow Fox to keep his job. If anything, he said Fox has proven to be a terrible businessman.

"A man's career is on the line here . . . This is not an issue of public corruption," Gambaccini said. "The chief was trying to do what is best for the department."

At issue is Fox's administration of a three-day self-defense instructor course known as RAD - Rape Aggression Defense Systems - in April 2004, and February 2005 and 2006, and his use of community policing funds.

Because Fox had participants send checks for the course to his home, and held the programs on town property - Chestnut Hill Community School and the Police Department's community room - without paying a fee, officials say he violated state and local laws dealing with conflict of interest, municipal finance and Police Department operations.

Terry contended that Fox benefited personally from the program, although Fox's wife Ellen said they never turned a profit.

Gambaccini said Town Administrator Gary L. Brougham has "an ax to grind" with Fox because Brougham's son, Adam B. Brougham, a police officer, was disciplined by the chief.

Brougham denied that he was biased, and said it pained him to go through this process. He said he had always hoped that Fox would be chief someday.

"I never wanted to bring this embarrassment to the community or anybody else," Brougham said.

The instructor class came to Brougham's attention when he drove by the police station and noticed a lot of vehicles. Further investigation showed that Fox was taking payment for the course at his home, even though the registration form said it was sponsored by the Belchertown Police Department.
